1. Acceptance of Terms
By accessing or using the services provided by Toolbox Hosting ("we," "us," or "our"), including our website at toolboxhosting.com and all related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Description of Services
Toolbox Hosting provides web hosting, email hosting, domain management, and related internet services. Our services include but are not limited to:
- Shared and managed web hosting
- Email hosting powered by Mailcow
- SSL certificate provisioning
- Domain registration and DNS management
- Website migration services
3. Account Terms
You must be at least 18 years old to use our services. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.
4. Payment & Billing
Paid services are billed in advance on a monthly or yearly basis. All payments are processed securely through Stripe. Prices are listed in USD and are subject to change with 30 days' notice. We do not offer refunds for partial billing periods except as required by law or under our 14-day money-back guarantee for new subscriptions.
5. Acceptable Use
You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. We reserve the right to suspend or terminate accounts that violate our policies.
6. Service Level Agreement
For Business plan customers, we offer a 99.9% uptime guarantee as described in our Service Level Agreement. Free and Starter plans are provided on a best-effort basis.
7. Data & Privacy
Your use of our services is also governed by our Privacy Policy. We take reasonable measures to protect your data, but you are responsible for maintaining backups of your content.
8. Termination
Either party may terminate this agreement at any time. You can cancel your subscription from your account dashboard. Upon termination, your data will be retained for 30 days before permanent deletion. We may terminate or suspend your account immediately if you violate these terms.
9. Limitation of Liability
To the maximum extent permitted by law, Toolbox Hosting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through our website. Continued use of our services after changes constitutes acceptance of the new terms.
